Homma Talent LLC is committed to protecting the privacy and security of the personal information entrusted to us by Candidates and Clients. This Privacy Policy outlines the information we collect, including how we collect, use, disclose, and safeguard the information – among other things.

This Privacy Policy applies to the information we collect through our website, forms, emails, and interaction with our recruitment team and our third parties.

By using our Services, submitting personal information through our website or other channels, or otherwise interacting with Homma Talent, you consent to the practices described in this Privacy Policy. If you do not agree with any aspect of this Privacy Policy, please do not provide us with your personal information or use our Services.

The below words have the meanings attached to them under this Privacy Policy:

ARCO rights refer to the rights granted to Candidates under Mexico’s Federal Law on Protection of Personal Data Held by Private Parties (FLPPHPP).

Consent is a voluntary act or agreement by a user allowing Homma Talent LLC to process their information for a specified purpose.

Client refers to any entity (represented by an individual) using our Services to hire Candidates (talents) for employment purposes within the United States.

Candidate refers to the Mexico based user who interacts with Homma Talent for the purpose of applying to work with any of our US Client, as advertised on our careers page.

By “we,” “us,” or “our,” we refer to Homma Talent LLC, the provider of the website and Services.

By “user,” “you,” or “your,” we refer to the user of our website and Services, including if you are using them as a Candidate, Client (through its representative), or website visitor.

Who we are

Homma Talent LLC specializes in recruiting and relocating Candidates in Mexico for Clients in the US. We are a company registered and operating in the State of Illinois, US. We are responsible for the information you submit to us with respect to our Services. We handle and use your information in accordance with the laws of the US.

Information Collection

We collect both personal and non-personal information required to identify the needs of Clients, collect applications from Candidates and process their relocation, communicate with users, gain insights about the progress of our Services, comply with the law, and secure our users and our Services.

The information we collect may be classified into:

  • The information users provide: From Candidates, we collect names, email addresses, phone numbers, Date of Birth, Passport, ID, employment history, education history, Passport, VISA and immigration history, and Resume. From Clients, we collect representative and company information. This includes the company name, website, registration, EIN, current job openings, and similar information.
  • The information we obtain automatically: We automatically collect or log information about anyone using our website and the parts they interact with it. This information may include their device properties (like the IP address, browser information, and geolocation), their referring website, and their interaction with our content (for example, if they have interacted with any job post).
  • Sensitive information: Some of the information Candidates provide, including their educational history and passport, may be termed sensitive personal information under certain laws. We collect such information only to provide our Services, including to assess a Candidate’s suitability for a job, their eligibility to travel, and verification of their background. We do not retain this information for longer than necessary.
  • If you are a Client (or a Candidate) using our website from the State of California or locations with similar privacy laws, we collect the following categories of information from you:
  • Personal and Online Identifiers: This may include any information that allows us to identify users, including names of representatives, phone numbers, email addresses, device IP addresses, website information, etc.
  • Professional Information: This is any information required to verify if a Candidate qualifies for a role, including the Candidate’s Resume/CV, employment history, education history, and skills and expertise.
  • User-generated content: This is any attachments a user submits as part of their application or message to us. This includes their photo and files provided during their application or message to us.
  • Contact Information: This is any information that allows us to communicate with users. This may include their email addresses, phone numbers, and mailing addresses.
  • Company Information: This is any information that may help us to identify and verify the Client’s company. This may include the Client’s company name, registration information, and Employer Identification Number (EIN).
  • Internet Activity Information: This may include information about how users interact with our content, pages, and Services. This includes the device properties used, log data, and usage patterns and preferences.
  • Geolocation and Location: This may include the geographic location of the user’s IP address and the precise location of a Client’s business address.
  • Social Media Information: This is a Candidate’s social media profile. This may include LinkedIn and Facebook profiles.

 

Information Sources 

We may collect the above information from the following sources:

  • Users: Most of the personal information we collect is submitted directly by users to us willingly. This may include when users contact us via our website or email address; apply for a job through our careers page; engage in an interview with us; or use any other form provided by Homma Talent LLC or our partners.
  • Cookies and tracking technologies: We automatically collect information using tracking technologies like Cookies, Beacons, Pixels, GIFs, and Tags. These technologies may be embedded on our website and in third-party tracking tools like Google Analytics.
  • Third-party sources: We may collect information about users, especially Candidates, from other sources. This may include their provided LinkedIn and Facebook profiles, our recruitment agencies and partners, background check providers, and publicly available databases. Another user may also provide us with your information (for example, when they use the “Refer a Friend” feature on our website).

 

Information Usage

We use the information we collect from users for various purposes, including but not limited to:

  • Providing our Services: To a Client, we use their information to assess their needs and provide them with a suitable Candidate. To a Candidate, we use their information to assess their qualifications, sort their relocation needs, and employ them on a Client’s behalf.
  • Improving our Services: We use information gathered automatically to operate, maintain, and improve our website, including enhancing user experience, developing new features, and optimizing performance.
  • Communicating with users: We collect contact information to enable us to provide support services, facilitate communication between us and users, respond to requests and queries, and provide updates about their applications. We also use your email address to send your marketing newsletters.
  • Facilitating recruitment processes: We use information, such as Resume/CV, skills, and education, to match Candidates with the right job opportunities and streamline the recruitment process.
  • Analyzing and conducting research: We collect analytics to analyze the progress of our website features and content. This includes analyzing user behavior, trends, and patterns on our website, as well as troubleshooting and understanding how our Services can be improved.
  • Comply with the law: We may collect certain information to enable us to comply with the law, enforce our Terms of Use, protect our rights and interests, and prevent unlawful activities.

We do not share or disclose your information with third parties other than as described in this Privacy Policy. We may share information as described below:

Disclosure to third-party service providers

We work with a number of third-party companies to provide our website and Services. These third-party companies may provide us with services, such as data storage, website management and security, Applicant Tracking System (ATS), and analytics providers (see a list of our major third-party service providers at the bottom of this Privacy Policy).

Candidate information shared with a Client

If you are a Candidate and have been considered for a role with a Client, your information may be provided to the Client for identification purposes.

 

Disclosure to entities in a Business Transfer Transaction

We may share personal information with companies involved in any business transfer transaction with us. This may include entities we are involved with in a sale of assets, a merger, an acquisition, a consolidation, or a case of bankruptcy. User list may be one of the assets disclosed as part of the business transfer transaction. In that case, we will communicate the transfer to you before it happens – unless we are prevented by any applicable law.

Disclosure to law enforcement

We may be legally obligated (including by law enforcement and government agencies) to disclose personal information about you. This may include in response to an ongoing investigation, court orders, subpoenas, and other legal proceedings. Also, we may disclose personal information in connection with the protection and prevention of our rights and properties, or those of other users and third parties.

Homma Talent LLC takes the security of its users’ information seriously, and we are committed to protecting it from unauthorized access, disclosure, alteration, and destruction. We employ the following data privacy practices:

We use industry-standard encryption protocols (such as HTTPS, SSL, and TLS) to ensure that the data shared between your browser and our servers is encrypted during transit.

The data Candidates provide when applying for roles is stored on servers with restricted access to authorized personnel only.

Access to user personal information is restricted to employees, consultants, and service providers who have a legitimate need to access it for the purposes outlined in this Privacy Policy. Access permissions are granted on a need-to-know basis and are regularly reviewed and updated as necessary.

We carefully select and vet third-party service providers that have access to your personal information. We ensure their security practices align with industry standards before we use their services.

While we take reasonable precautions to secure your personal information, it’s important to recognize that no method of transmission over the internet or electronic storage is completely secure. Therefore, we cannot guarantee the absolute security of your information.

In the event of a data breach or security incident that may compromise your personal information, we will notify you and relevant authorities as required by applicable laws and regulations.

Information Retention

We retain personal information in accordance with the law and this Privacy Policy. We retain personal information for the duration of the purposes for which we collect it. Unless a deletion request is made, we initially retain Candidates’ information in our database for 4 years (the duration of their contract with a Client), after which we delete it completely from our database after 10 years.

All users can request the deletion of their information, and it will be granted within 30 days. This does not include circumstances where the information is needed for use in an ongoing investigation, or where we are required by law to maintain records for a certain period.

International Transfer of Information

As a Candidate submitting personal information to us from Mexico or any other location, please be aware that when you submit your information to us, we handle it in accordance with the US privacy laws. This information may also be shared with the applicable Clients and third-party service providers in the US and other locations. By using our Services, you agree to the transfer and use of your information in accordance with this Privacy Policy.

Children Policy

Our Services are not targeted at people under 18 years of age. Therefore, we do not solicit personal information from children. Please do not use our website, apply for our Services, or submit personal information to us if you are under 18 years of age. If we discover that you are under 18 years of age, we take steps to terminate our Services with you and delete your information from our database. If you are a parent and you believe that a child has submitted personal information to us, you can reach out to us at contact@hommatalent.com to have it deleted.

User Privacy Rights

Homma Talent LLC is committed to protecting your privacy and rights. You have the following rights in relation to the information we handle about you. They include privacy rights provided under applicable US laws, including without limitation, the CCPA/CPRA, Virginia Consumer Data Protection Act (VCDPA), Nevada rights, ARCO rights, among others.

  • Right to know and access: You have the right to request information about the collection, use, and disclosure of your personal information over the past 12 months. Upon verified request, we will provide you with access to the specific pieces of personal information we have collected about you.
  • Right to correct or rectify: Users have the right to correct their personal information held by Homma Talent LLC. If you would like to access or update your information, please contact us or reach out directly to your designated contact person at Homma Talent LLC.
  • Right to delete or cancel your information: Users have the right to contact us (Candidates and Clients can reach out to the consultant assigned to them) to request that we delete their information. This right is absolute, as we may be unable to grant this request if applicable law prevents it or we need it in an ongoing claim or for right protection/prevention.
  • Right to data portability: Where technologically feasible, you have the right to receive the personal information you have provided to us in a portable and, to the extent technically feasible, readily usable format that can be transferred to another entity without hindrance.
  • Right to oppose: Under the ARCO rights, you can object to the processing of your information for specific purposes, including in connection with marketing.
  • Right to opt-out of the sale of personal information: If applicable, you have the right to opt-out of the sale or sharing of your personal information. We do not directly sell personal information to third parties for monetary consideration, and we do not share information about your behaviors in connection with interest-based or targeted advertising. However, we may share videos and photos of users with our marketing partner for marketing purposes. You can opt out of this sharing by contacting us. Clients from California can opt out using the “Do Not Sell My Information” banner on the website.
  • Right to non-discrimination: We will not discriminate against you for exercising any of your privacy rights. This includes but is not limited to, denying you goods or services, charging you different prices or rates for goods or services, providing you with a different level or quality of goods or services, or suggesting that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
  • Opting out of newsletters: Users have the option to unsubscribe from our periodic newsletter at any time. Each newsletter contains an “unsubscribe” link at the end, allowing users to opt out easily. If you encounter any issues with unsubscribing or have questions about our newsletter, please contact us.

Zoho: We use Zoho’s Applicant Tracking System (ATS), data storage, and other recruitment suites. This enables us to streamline our hiring and recruitment processes.

Google: We use certain tools and services from Google. These may include Google Analytics for analyzing our website, Google Drive for data storage, and email suite for communications. You can opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on.

WordPress: Our website is built and hosted on WordPress (a web platform from Automatic). They may embed cookies on our website to enable certain functions, including security and monitoring of violations of law.

Incom: We use Incom to market our platform on LinkedIn and similar social media platforms. We may share Candidate or Client information, including photos and videos, with Incom to assist us in creating a marketing campaign on LinkedIn.

Mailchimp: They help us with sending out newsletters to subscribers.
